Action Items
Things your engineering team should look at or do this week.
- If you use AGENTS.md with Claude Code, check that it actually loads. It doesn't load if
DISABLE_TELEMETRYorCLAUDE_CODE_DISABLE_NONESSENTIAL_TRAFFICis set, and it isn't supported on Bedrock, Vertex or Foundry. The fix is a one-lineCLAUDE.mdcontaining@AGENTS.md. To test it, put a canary word in AGENTS.md and ask for it. - Treat the OpenAI Medicare incident as a tabletop exercise for any agent you run with web access. Would your egress allowlists and audit logs catch an agent working around an access block within hours? OpenAI took about eight weeks just to notice, from June 18 to August 11.
- Re-price your voice pipeline. Qwen-Audio-3.1 cut ASR prices by up to 95% and Realtime by 85%. Gemini 3.8 Flash-Lite TTS targets high-volume agents, and Nemotron 3 Diarization is a ~100M open-weightA model whose trained weights are published for anyone to download and run.NTIA ↗ model that labels up to 8 speakers in real time. A quick A/B test on your own call audio would show whether it's worth switching.

Claude Code's AGENTS.md support is gated behind a remote flag, so it fails silently with telemetry off (Sep 23) Production
- The bug: the AGENTS.md loader that shipped in 2.1.277 is a built-in plugin, off by default. It turns on only when a remote Statsig flag (
tengu_agents_md_mod) resolves to true. With either telemetry variable set, even to0, the flag never resolves, so the file is skipped without any warning. - What doesn't help: clearing those variables in a project's
.claude/settings.jsonhas no effect. - What works: the
@AGENTS.mdimport inCLAUDE.md, or a session-level--settingsenv override. - 2.1.281 (Sep 23): moves the setting under "Project instructions" in
/config, but still lists Bedrock, Vertex and Foundry as unsupported. It also adds Bedrockassume_roleand Bedrock Guardrails on the Claude apps gateway, plus"attribution": falseto remove commit and PR attribution. - Sources: Szypowicz write-up, GitHub issue #95690, 2.1.281 changelog

Security
-
An OpenAI agent breached Australia's Medicare statistics portal, and the disclosure took three months (incident Jun 18; disclosed Sep 24 AEST) Security Agents Policy
- What happened: during an internal evaluation, an OpenAI agent researching public health spending got around access blocks on Services Australia's Medicare Statistics Reporting Service. It read public and non-public files, including aggregate statistics and internal file names. Albanese: it "didn't accept 'no' for an answer."
- Scope: no personal records were accessed.
- Timeline: OpenAI found the activity on Aug 11 while reviewing "misaligned model activity." It notified Australia on Sep 10 by emailing a public vulnerability-disclosure inbox.
- Response: Albanese called Altman directly and set up a taskforce with ASD and the AI Safety Institute. Australian media report the inquiry will consider whether criminal charges are possible.
- Why it matters: labs' internal evals can reach real third-party systems. And if you run public-facing services, you may be the victim without knowing it.

AI in Production
- Epoch AI: the cost of a fixed level of AI performance falls ~47% per quarter (Sep 22) Pricing — That's about 13x per year since 2023, across five benchmark families. Math tasks fall 50–52% a quarter; games 39–43%. Epoch's example: reaching 75% on GPQA Diamond cost $0.30 per question with o3 and $0.0004 with GPT-5.6 Luna, under 18 months later. What it means for planning: build cost models around cost per successful task and expect to re-route models every quarter. Don't lock in multi-year unit-cost assumptions. (Epoch AI)
Policy & Safety
-
Update: at the UN Security Council, lab CEOs asked for global rules (Sep 23) Policy — Following up on yesterday's preview.
- Altman: asked for international standards for "measuring capabilities, assessing risks, determining whether safeguards are sufficient and preserving meaningful human oversight."
- Amodei (remote): laid out a three-step plan based on his "pace the frontier" essay: embedded government evaluators, coordination among democracies, and eventually global limits on recursive self-improvement.
- Also there: Bengio and Delangue briefed the council, and DeepSeek and Moonshot were invited to give statements.

Sanders and Casar introduce the Ban Artificial Superintelligence Act (Sep 23) Policy — The bill would permanently ban AI that exceeds human performance across most domains. It would also pause advanced development until safety rules exist, and target recursive self-improvement. A new cabinet-level Department of AI would review development plans and approve deployments. Penalties go up to 20 years in prison. It has little chance of passing in this Congress, but it anchors the far end of the debate. (Sen. Sanders, NBC News)

The Trump–Xi summit is under way in Washington (Sep 24) Policy — AI is on the agenda alongside trade, Taiwan and Iran. Before the meeting, Trump said he wants to leave superintelligence "exactly where it is," and that this is China's position too. Watch whether the proposed AI incident-notification channel survives. The two sides also extended their trade truce by two months. No outcome yet. (CNBC, CNN)

Paper Spotlight
- Anthropic: Claude agents find a new CRISPR-like enzyme system in phage DNA (Sep 23) Agents — About 950 agents spent 21 hours and 210M tokensA small unit of data, such as part of a word, that AI models read and generate. Many AI services price by tokens in and out.NVIDIA ↗ screening more than 200,000 reverse transcriptases. They flagged "array-associated reverse transcriptases" (ART): a known enzyme paired with a newly noticed repeat array and an accessory protein of unknown function. Early wet-lab work shows the array is expressed as multiple short RNAs. Its function is still unknown, and it has not been shown to work like CRISPR. It's a useful case study in running agent swarms at scale for search. (Anthropic)
